Peter Beattie announces a "no fault" benchmark (ie with a maximum penalty of 11 years imprisonment or above), where players will be stood down automatically while facing serious criminal charges. The CEO may also suspend players "below the line" at his discretion, particularly in cases which involve violence against women and children.

Players will be allowed to train with their club and will be on full pay. Clubs will not automatically receive salary cap relief, but they will be permitted to seek relief on a case by case basis.

No fault stand down, bench mark for serious discretions, CEO able to act on any discretion. At pains to stress NRL not deciding on guilt. Begins start if this season.

Players charged with serious offence, auto stand down, stand down continues until charges dealt with. Players stood down can train and will receive full pay. No automatic relief, club can apply for salary cap relief, considered on a case by case basis.

Serious offence is defined as an indictable offence with max penalty of 11 years or above.

Jack de Belin stood down from NRL over sexual assault charge

St George Illawarra forward Jack de Belin has been stood down from the NRL while he contests a charge of aggravated sexual assault. The ARL Commission met on Thursday at League Central before announcing a major change to the game's disciplinary policy concerning players who are accused of serious crimes.

St George Illawarra Dragons grant Jack de Belin time away from all duties after being stood down by NRL

St George Illawarra have granted Jack de Belin time away to deal with the toll of the NRL's recent policy change in which he was stood down under the new "no-fault stand down" rule for players facing serious charges.

St George Illawarra Dragons forward Jack de Belin set to fight NRL ban in federal court

Jack de Belin is planning to challenge his NRL ban in federal court tomorrow. Channel Nine have reported that the St George Illawarra forward will also seek to gain an injunction against the NRL.

This will be fascinating. Maybe T_R can add a bit to this discussion. I'm intrigued as to how this will go down? DeBelin I'm assuming will be requesting his playing ban is overturned on the basis of him being innocent until proven guilty? And the NRL will be arguing that he is being stood down because of the damage it has caused to the organisation? Hard to argue with either side but I'd back the NRL on this one, overall.

I know we've had this discussion before, but I'm relatively certain any sporting organisation has the right to exclude players from their competition on any basis they see fit.

While I'm uanable to cite any specific laws I do believe you are right. You can't force a sporting body to let you play. They are the ones that set the rules and policies. If you want to play then you need to agree to abide by them.

Yes and so they should. I don't know why the game carries on the charade that the club's are the employer. And I honestly don't know that DeBelin has a leg to stand on. The NRL can just point to the figures suggesting that they have lost 10 million in sponsorship this off season.

From what the guys on 360 were saying that the NRL made sure they got it right from a legal sense before implementing the new not at fault policy.

I believe they did. They had to respond fairly quickly yet still took enough time to get the ducks lined up. For once I believe they got it right. The only real criticisms are quibbles about length of time suspended, amount of fines etc.

The judge presiding over Dragons star Jack de Belin’s Federal Court bid to overturn his ban says the forward will be free to play round one unless the NRL enacts it’s ‘no fault’ policy.

As of right now, Jack de Belin is free to play in round one, because the NRL has not yet introduced an actual rule to stand him down. The NRL will look to have said rule in place next week, but as it doesn’t yet exist, De Belin can’t legally be stood down.@FOXSportsNews

DeBelin has demanded the NRL pay for advertisements in order to restore his reputation. I doubt he will be successful in his request, but assuming he is successful, will that mean the NRL can sue the Dragons into having to become the second Brisbane team if he is found guilty?

So the NRL now formally incorporates the new no fault policy into their rules... simple. It is all a matter of timing... not really a "victory" for de Belin.

Wouldn't you incorporate the new policy before announcing said policy. Sure it's no victory for DeBelin but it does expose the NRL to more embarrassment through the media.

Agree , this was the process from the beginning. DeBelin has just got them on a technicality . The policy will be in place before he goes to court again next week.

It wouldn’t surprise me at all that De Belin’s lawyers knew precisely what they were doing with the timing. Ben Ikin and Paul Kent were getting stuck into the NRL over it, but I’m not going to be too critical of the NRL. They’ve taken the right stance and made clear what they were going to do in a timely way.
